Terms of Service

1. Who you are contracting with

This website and service are operated by Agbede Treasure Ademola, trading as NourrishAfrica. Agbede Treasure Ademola is an Individual Sole Proprietor based in Nigeria ("we", "us", "our"). By creating an account or using the service you enter into a binding agreement with Agbede Treasure Ademola.

2. Eligibility

You must be at least 13 years old to use NourrishAfrica. If you are between 13 and the age of majority in your country, you may only use the service with the involvement of a parent or guardian. If you use NourrishAfrica on behalf of an organisation, you confirm you have authority to bind that organisation.

3. Accounts

You are responsible for keeping your credentials secure and for all activity on your account. You agree to provide accurate information and keep it up to date. Notify us immediately of any suspected unauthorised access.

4. Acceptable use

You agree to use NourrishAfrica lawfully and not to: (a) misuse the service or its AI features; (b) attempt to reverse-engineer, resell, redistribute or copy the service; (c) upload malware, probe for vulnerabilities, scrape at scale or otherwise interfere with security; (d) infringe the intellectual property or privacy rights of others; or (e) submit unlawful, harmful or misleading content. Nutrition information is educational and does not replace medical advice — always consult a healthcare professional for medical decisions.

5. Intellectual property

Agbede Treasure Ademola retains all right, title and interest in and to the NourrishAfrica service, including its software, content, verified food database, and branding. We grant you a limited, non-exclusive, non-transferable, revocable right to use the service within your selected plan.

6. User-generated content

You retain ownership of the content you submit (food logs, photos, notes, messages to Nouri). You grant us a worldwide, non-exclusive, royalty-free licence to host, process and display that content solely to provide and improve the service. You are responsible for having the rights to any content you submit.

7. AI services

Nouri AI generates responses, meal plans, food identifications and insights from your inputs. You must not use Nouri AI to generate illegal content, deepfakes, hate speech, malware, or to attempt to jailbreak safety controls. AI outputs may be inaccurate and must not be relied on for regulated medical, legal or financial advice without professional oversight. You are responsible for your prompts and how you use the outputs.

8. Subscription plans, billing and Merchant of Record

When purchasing any digital product or subscription through NourrishAfrica, you are purchasing from Paddle.com Market Limited, which acts as the Merchant of Record.

Paddle is responsible for:

• Payment Processing
• Billing
• Tax Collection
• Invoices
• Renewals
• Eligible Refunds
• Payment Security
• Fraud Prevention

NourrishAfrica receives confirmation from Paddle after successful payment and then activates the purchased subscription.

The legal agreement for payment is between the customer and Paddle.com Market Limited.

Our plans are offered as follows:

• Free — $0, limited access.
• 3-Day Pass — $1.55, one-time purchase that does not auto-renew.
• Pro — $9.99/month or $79.99/year, auto-renewing.
• Elite — $24.99/month, auto-renewing.
• Founding Member — $29 one-time lifetime purchase that grants 3 months of Pro and a permanent 30% discount on Pro thereafter.

Prices are shown in the currency displayed at checkout. Payment, tax, invoicing, cancellation and refund mechanics are governed by the Paddle Checkout Buyer Terms.

9. Renewals

Recurring subscriptions renew automatically at the then-current price for the same billing period until cancelled. Paddle will attempt to charge your payment method on file on each renewal date and will notify you of upcoming renewals as required by law.

10. Cancellation

You may cancel a subscription at any time from your profile or via paddle.net. Cancellation prevents future renewals and access continues until the end of the current billing period.

11. Suspension

We may suspend access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Where reasonable, we will notify you and give you an opportunity to remedy the issue.

12. Termination

We may terminate your access for continued breach, prolonged non-payment, or where we discontinue the service. On termination, your right to use the service ends and we may delete your account data in accordance with our Privacy Policy. You may terminate at any time by deleting your account.

13. Disclaimers

NourrishAfrica is provided "as is" and "as available". We do not guarantee that the service will be uninterrupted, error-free or continuously available, or that AI outputs will be accurate. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

14. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the service is limited to the amount you paid (via Paddle) for the service in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential or special damages, including loss of profits, data or goodwill. Nothing in these terms excludes liability that cannot be excluded by law.

15. Governing law

These terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws rules. Disputes will be resolved by the competent courts of Nigeria, subject to any mandatory consumer protections available to you in your country of residence.

16. Changes

We may update these terms and will notify you of material changes in-app or by email. Continued use of the service after changes take effect constitutes acceptance.
